Artis Trade Systems, Inc (“Artis”) values the privacy of those who use our website and platforms. As used in this Privacy Policy, “you” or “user” means both (a) the individual now using, accessing, or registering as a user of the website or platforms.  This Privacy Policy, as modified from time to time, describes the collection, use, and disclosure of personal information in connection with our website, found at artistrade.com (“Website”) and web application platforms, ArtisPay® and ArtisPro, together with all subdomains and related websites, and together with related software-as-a-service systems (“Platforms”). Collectively, the Website and Platforms are referred to as the “Services”.

By visiting or using the Services, you agree to the practices and policies set forth in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you must not use the Services. 

  1. Information We Collect

We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household (“Personal Information”) about you when you use our Services and otherwise interact with us. The information we collect falls into three categories: (a) information you provide to us; (b) information we collect through automated methods when you use our Services; and (c) information we collect from other sources (as further detailed below).  

Information You Provide. There are a number of circumstances in which you may voluntarily supply us with your Personal Information, including: 

  • Signing up to receive information or related services from us.

  • Registration for an account on the Services to enable you to use Service functions, such as utilizing Artis’ Platforms.

  • Any other place on the Services where you knowingly volunteer personal information.

Business Contracts. When a business contracts directly with us for the purchase of our products or services, we may collect the business contact information of those involved. The processing of any information provided in such a business context is governed by the contracts between that business and Artis.

Feedback and Testimonials. When you provide comments or feedback about our Services, the content on the Services, or our products ("Feedback"), we will not treat that Feedback as confidential, and we may use that Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback will be used without attribution or compensation to you.

Social Media. When you interact with an Artis account on a social media platform, such as Facebook, Twitter, Instagram or YouTube, we may collect the Personal Information that you make available to us on that page or account, including your user ID and/or username, and any information you have made public in connection with that social media service. Anything you post on social media is public information and will not be treated confidentially. We may post (or re-post) on the Services and our social media pages any comments or content that you post. 

Our Services may include social media widgets, such as Facebook, YouTube, and Twitter widgets. These features may collect information about your IP address and which page you’re visiting on our Services, and they may set a cookie to make sure their feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Services.  Please note that use of social media platforms, including widgets, is governed by the privacy policies and terms of the providers of such platforms and not this Privacy Policy. We encourage you to review those applicable policies and terms.

Information Automatically Collected.  When you interact with the Services, we automatically receive and record information on our server logs from your browser, including your IP address, “cookie” information, and the page you requested. The Cookies on our Site may collect information such as: the IP addresses assigned to the computers and other devices you use; your internet service provider (ISP); device ID number; approximate geographic location; browser type; Website pages visited; and data related to how and when you use the Site.

Most browsers are initially set to accept cookies, but you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether. Please consult the “Help” or “Settings” section of your browser for more information. Please note that by blocking any or all cookies, you may not have access to certain features, content, or personalization available through the Services. You cannot disable all cookies, such as cookies that are essential to the functioning of the Website. 

Data from Other Sources. We may obtain Personal Information from various third-party companies and public sources, and we may combine that data with other Personal Information. This enhances our existing data about our users, improves our ability to contact you, and enhances our marketing capabilities.

Video Content.  The Website may contain videos and embedded content provided by Artis Trade and other parties, including visible content and/or feeds scripts embedded in the Website's code. Artis Trade and such other parties may collect data about how you interact with such content. For example, YouTube may collect usage data on videos embedded on the Website. Even if you do not watch videos, YouTube may still collect certain information about your interactions with our Website if you are signed into your YouTube account or Google account when accessing our Website.  YouTube, LLC is owned by Google. “Do Not Track” Practices. At this time, we do not honor do-not-track signals from browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data. While we collect Personal Information from you as described above, we do not collect personal information from you to monitor your online activities across third party services or online services and over time (also known as behavioral advertising or interest-based advertising).

Email and Other Communications. We may contact you by email or other means at an email address that you have provided to us. For example, we may send you promotional offers or our newsletter. If you do not want to receive email from us, please use the “unsubscribe” feature included in our communications.

We use Personal Information to help us personalize and continually improve your experience with the Services. As non-limiting examples, we may use Personal Information in the following ways:

  • Provide you with the products and services you request from us, such as access to the features of the Services;

  • Communicate with you about your account with us or your use of the Services, and send you information about features on the Services;

  • Communicate with you about changes to our policies;

  • Personalize content and experiences on our Services;

  • Share your Personal Information with others you may be interacting with through the Services;

  • Send you newsletters, offers, or special events by email or other media;

  • Optimize or improve our products, services, and operations, including analytics;

  • For fraud prevention purposes, and to detect, investigate, or prevent activities that may violate our policies or be illegal;

  • To protect our legal rights or interests, or those of other parties, including to bring a legal action against you or anyone who may be causing harm to us, our Services or to users of the Services, or to seek business, financial or legal advice, and to respond to other legal requests;

  • As stated, requested, or agreed to at the point of collection;

  • For administrative purposes, such as such as managing accounts, facilitate communications and transactions, to inform our business strategies, and to understand demographics and user preferences; and/or

  • To manage and maintain the Services, such as troubleshooting and improving the content and functionality of the Services.

Use and Disclosure of Non-Personal Information. Artis may collect, use, disclose, transfer and otherwise process de-identified and aggregated information that it receives or creates for any purposes in its sole discretion, in compliance with applicable laws. Artis is the sole and exclusive owner of such de-identified and aggregated information, including if Artis de-identifies Personal Information so that it no longer considered Personal Information under applicable laws.    

  1. Our Disclosure of Personal Information

We may disclose Personal Information to the following categories of recipients: 

  • Employees and affiliates who have a need to know the information for our business purposes. 

  • Third-party service providers, such as contractors, agents, or sponsors, who provide us services, such as to help us manage or provide services offered on our Services, including third parties that provide hosting, analytics, customer service, advertising, security, and analytics services. 

  • Professional advisors, such as such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to Artis.

  • Other parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

We may also use or disclose your Personal Information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us or the Services; (b) respond to requests from public and government authorities; (c) protect and defend our rights or property, the Services, or our users; and (d) act under emergency circumstances to protect the personal safety of us, our affiliates, agents, or the users of the Services or the public.

Merger, Sale, Or Bankruptcy. If we sell all or part of our business, or make a sale or transfer of our assets, or are otherwise involved in a merger or transfer of all or a material part of our business, or are involved in a bankruptcy, Artis may transfer your information to the party or parties involved as part of that transaction.

We are concerned about ensuring the security of your Personal Information. We use commercially reasonable efforts to protect your Personal Information collected through the Services to protect it from access, loss, misuse, alteration, or destruction by any unauthorized party. But no transmission of data over the internet or any other public network can be guaranteed to be 100% secure. We do not promise, and you should not expect, that your Personal Information or private communications will always remain private. You are also responsible for taking reasonable steps to protect your information against unauthorized disclosure or misuse such as by maintaining the confidentiality of your username and password, and logging out of your account when not using the Services. We will keep Personal Information for the period necessary to fulfil the purposes described in this Policy, unless a longer retention period is permitted or required by law.

Please note that the Services may link to other websites and applications operated by third parties. These third-party websites and applications operate independently from us, and we do not control their privacy policies, which may be different from ours. We encourage you to review the privacy policies of any third-party websites or applications. 

  1. Children’s information

The Services are not directed at children under 18 years of age. We do not knowingly collect, sell, use, or share Personal Information from children under 18. If we obtain actual knowledge that any Personal Information we collect has been provided by a child under the age of 16, we will promptly delete that information. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information.

  1. Notice to Non-U.S. Users

As the Internet is a global environment, collecting and processing personal information may involve the transmission of this data internationally, including into and/or outside of the United States. Therefore, by communicating electronically with us, you acknowledge and agree to your personal data being processed in this way.

Specifically, if you are located outside of the United States, please be aware that by using the Services, your Personal Information may be transferred to the other countries, the privacy laws of which may be deemed to have inadequate data protection. If you are located outside of the United States and voluntarily submit Personal Information to us, you thereby consent to the general use of that information as provided in this Privacy Policy, and to the transfer of that information to, and storage of that information in, the United States.

We reserve the right to amend this Privacy Policy from time to time in our sole discretion, and will post and maintain the most recent version of the Privacy Policy on the Services. All changes will be effective immediately upon posting to the Services. Material changes will be conspicuously posted on the Services or otherwise communicated to you. You can determine if the Privacy Policy has been revised since your last visit by referring to the “Last Modified” date at the top of this Privacy Policy.
